📝 The legal procedure step by step
📍 Where it happens: the Comune
Civil weddings in Italy are conducted by a civil officer (usually the mayor or a delegate) at venues officially approved by the Comune. In Puglia, this includes masserie, castles, town halls, and even panoramic terraces in the countryside.
🧾 Step 1: Declaration of no impediments
This is a mandatory step:
- Signed in person at the Town Hall
- Can be arranged a few days in advance, at the presence of an interpreter if required.
How it works
If both spouses are foreign nationals not residing in Italy, civil banns are not required and they must show up at the town hall 1 or 2 day before the wedding day to state that there are no legal impediments to affinity, adoption, or affiliation between them under art. 87, numbers 1, 2, and 4 of the civil code, nor are there any other impediments according to art. 85, 86, and 88 of the same code.
📣 Exception to the Declaraiton of no impediments:
Civil Banns (Pubblicazioni di matrimonio)
Required only if:
- 🏠 One or both spouses are resident in Italy, even if foreigners
- 🇮🇹 One of the spouses is Italian and registered with A.I.R.E.
In the case of A.I.R.E. citizens, banns must be published by the Italian Consulate abroad.
✔️ We manage all communication with the Comune or Consulate to ensure compliance.
🌍 Interpreter
If either of you does not speak Italian, a sworn interpreter is legally required for:
- The Declaration of no impediments
- The Civil Ceremony
We provide certified interpreters fluent in your language 🗣️
👥 Witnesses
You will need two adult witnesses (18+) with valid ID. They can be friends or relatives.
The witness must show up only at the civil ceremony, not at the declaration of no impediments.
If you’re eloping or don’t have guests, we can provide official witnesses 🤝
What is the Marriage Nulla Osta
A Nulla Osta is a certificate issued by your country that confirms you are free to marry under your national laws. It is a required document for all civil weddings in Italy.
In most cases:
- It is issued by your consulate in Italy
- Once issued, it must be legalized (authenticated) at the competent Prefettura, depending on international agreements
🇺🇸 USA and 🇦🇺 Australia: Nulla Osta + Atto Notorio
If you are an American or Australian citizen, you will need:
- A Dichiarazione giurata for Americans and a Nulla Osta for Australian issued by the respective embassy or consulate in Italy
- An Atto Notorio, a sworn declaration made before two witnesses, before:
- the competent Italian consulate abroad, or
- the Italian court (Tribunale Civile) in Italy
We’ll help you schedule appointments and provide the right document templates.
Thanks to our experience, at the Italian Court we can streamline the process avoiding you to bring any documents from the U.S.
Other countries: Nulla Osta issued in your home country
Some countries issue the Nulla Osta directly from their national authorities, due to bilateral agreements with Italy. In these cases, the steps are:
- Translate the document into Italian by us through a sworn legal translation (asseverazione) at an Italian court
- If your country is part of the Hague Convention, the document must be legalized with an apostille
- If not, the legalization must be done by the Italian consulate in your country
Examples of countries that follow this procedure:
🇬🇧 United Kingdom • 🇱🇹 Lithuania • 🇳🇴 Norway • 🇲🇽 Mexico • 🇸🇪 Sweden • 🇫🇮 Finland • 🇩🇰 Denmark • 🇳🇱 Netherlands • 🇨🇭 Switzerland
Monaco Convention and the Certificate of Capacity to Marry
If you’re from a country that signed the Monaco Convention (1980), you may present a Certificate of Capacity to Marry (Certificato di Capacità Matrimoniale) instead of the Nulla Osta.
✔️ This certificate must be:
- Multilingual
- Issued by a competent official authority
- No legalization or translation required
Countries that accept this option:
🇧🇪 Belgium • 🇫🇷 France • 🇩🇪 Germany • 🇱🇺 Luxembourg • 🇳🇱 Netherlands • 🇪🇸 Spain • 🇨🇭 Switzerland • 🇹🇷 Turkey
