Civil Wedding in Naples – marriage requirements
Getting married in Naples offers a unique blend of history, culture, and romance.
However, understanding the legal requirements and procedures is crucial to ensure a smooth process.
This guide provides step-by-step details for foreign couples who wish to marry in Naples, covering the key steps, required documents, and practical considerations.
Getting Married in Naples
1. Venue Booking: Sala Loggia and Castel Nuovo
One of the most iconic venues for civil weddings in Naples is the Sala Loggia at Castel Nuovo. To secure this location:
- Your consultant will coordinate with the Naples City Council to check availability.
- Once availability is confirmed, a formal application must be submitted no later than 20 days before the ceremony.
- The application must include a legalized Nulla Osta (or a legalized affidavit for Americans, and a certificate of marriage capacity for countries adhering to the Munich Convention), obtained from your consulate in Italy. This document will be duly legalized by us at the competent prefettura.
Please note that, in addition to the Nulla Osta or affidavit, Australian and American citizens must obtain an Atto Notorio in an Italian court. Our team provides fast support to assist with this process. - Payment for the venue is mandatory to finalize the booking and to notify the Civil Status Office.
For other locations like Antisale dei Baroni or the Monumental Courtyard, we will have to prepare a specific request to the Cultural Heritage Service of Naples.
2. Civil Marriage Applications – Marriage Banns
If one of the spouses resides in Naples, the application for marriage banns must be submitted to the Civil Status Office of the Naples City Council. Required documents include:
- Proof of residency for the Naples-based spouse.
- Valid identification documents for both parties.
Delegated Celebrations: The Mayor of Naples has the power to delegate the ceremony to an Italian citizen eligible for municipal office. A request must be submitted 30 days in advance, ensuring the delegate has no familial ties to the couple.
3. Non-resident Foreign Couples
If neither member of the couple is a resident in Italy, no marriage banns are required, and a smoother procedure is followed.
The couple must appear at the Naples Town Hall to swear a declaration stating there are no impediments to their marriage due to kinship, affinity, adoption, or affiliation, as per Article 87, numbers 1, 2, and 4 of the Italian Civil Code, and that no other impediments exist according to Articles 85, 86, and 88 of the same code.
This declaration is required by Decreto del Presidente della Repubblica 3 novembre 2000, n. 396.
4. Recommended Timeline
It is advisable to start the legal procedures at least 50 days before your wedding date, as the following steps can take time:
- Obtaining and legalizing the Nulla Osta or equivalent documents.
- Legalizing the nulla osta.
- Coordinating with the embassy and Civil Status Office.
- Finalizing the venue booking and completing necessary payments.
