Special Cases & Exceptions by Nationality – Updated Aug 2026
🇬🇧 United Kingdom
If resident in the UK give notice, obtain a CNI and sign a bilingual statutory declaration; the British Embassy/Consulate in Italy issues the Nulla Osta on that basis. If resident abroad you can apply via the British Embassy in Rome or through a local notary as instructed by the Embassy.
Both CNI and statutory declaration typically require UK Legalisation Office apostille; we handle the CNI sworn translation at the Italian court. The Embassy Nulla Osta is generally accepted by Roma Capitale.

🇺🇸 United States
Core document the sworn affidavit (Dichiarazione Giurata) which serves as the Nulla Osta, usually followed by legalisation at the Prefettura before filing with the Comune. An Atto Notorio is also required at an Italian court or Italian Consulate.
Under current practice, birth or divorce certificates are generally not requested for the Atto Notorio. Embassy appointments do not usually require extra civil-status documents.

🇨🇦 Canada
Required document marriage Nulla Osta issued by the Canadian Consulate in Rome after a marriage affidavit sworn either in Canada before a notary public or directly at the Consulate. The Nulla Osta must be legalised at the Prefettura before submission to the town hall.

🇦🇺 Australia
Australian citizens swear a statutory declaration before the Australian Consul in Rome (used as the Nulla Osta), then legalise the Consul’s signature at the Prefettura. An Atto Notorio is required at an Italian court. Under bilateral practice, birth or divorce certificates are typically not needed for the Atto Notorio.

🇷🇺 Russia

🇩🇪 Germany
Certificate of Capacity to Marry issued by the local Standesamt. Under the Munich Convention this multilingual certificate is normally accepted in Italy without translation or legalisation.
🇦🇹🇱🇺🇳🇱🇵🇹🇪🇸🇨🇭🇹🇷🇲🇩 Munich Convention countries
Austria, Luxembourg, Netherlands, Portugal, Spain, Switzerland, Türkiye and Moldova follow the same simplified route as Germany: a multilingual Certificate of Capacity to Marry typically accepted in Italy without extra translation or legalisation.
🇳🇴 Norway
Marriage permit issued by the Norwegian registry office, translated into Italian by a sworn translator in Norway and apostilled in Norway under the 1961 Hague Convention.
🇵🇱 Poland
The Nulla Osta is normally issued by the Polish civil registry office. Exception when the citizen never resided in Poland, cannot confirm last registered residence there, or left before age 16 with permanent residence abroad, in those cases the Polish Consulate in Italy issues it.
🇭🇺 Hungary
Exception for Hungarian citizens, the substitute certificate in lieu of the Nulla Osta is issued by the Embassy of Hungary, pursuant to Italian Circular No. 11/2013.
This certificate is exempt from legalisation and may be filed directly with the Italian Comune.
🇲🇽 Mexico
Key document Constancia de Inexistencia de Registro (or state-equivalent) issued by the Civil Registry of the state of birth or residence. Valid if issued within six months, must carry a Mexican apostille and be translated into Italian, ideally in Italy with court-sworn translation (asseverazione) to avoid challenges.

🇨🇴 Colombia
Nulla Osta from the competent Colombian consulate (Rome generally covers central-southern regions, Milan covers others). Submit documents as a single PDF, pay the consular fee, then collect the certificate. Extra documents apply if divorced or widowed. Foreign-issued documents must be apostilled before use in Italy.
🇩🇰 Denmark
Nulla Osta issued by the Danish municipal registry (in Danish, English or German) plus Italian sworn translation carried out in Denmark. Both the original and translation require apostille by Denmark’s Ministry of Foreign Affairs.
🇱🇹 Lithuania
Nulla Osta issued by the municipal Civil Status Office in Lithuania, recognised by Italian authorities. Apostille in Lithuania is required. Translation into Italian can be done in Lithuania (and apostilled) or in Italy via court-sworn translation.
🇸🇪 Sweden
Nulla Osta from the Swedish municipal registry for residents in Sweden, with Italian sworn translation and apostille from Sweden’s Ministry for Foreign Affairs. The Embassy in Rome issues certificates only in limited cases, for example Swedish citizens resident in Italy.
🇫🇮 Finland
Certificate of Capacity to Contract Marriage before a Foreign Authority per Italian Circular No. 1/2014, consisting of the Finnish original and its Italian translation. Both require apostille in Finland.
🇸🇾 Syria
For Syrian citizens resident in Italy, the Nulla Osta is requested from the Embassy of Syria in Vienna, then legalised by the Italian Consulate in Vienna and translated into Italian in compliance with art. 22 of DPR 396/2000.
What to do if you cannot obtain the Nulla Osta
If neither a Nulla Osta nor a Certificate of Capacity can be produced, you may still request marriage banns, but the Civil Status Officer must refuse the application. The written refusal can be challenged before the competent Tribunal, which decides in chambers after hearing the Public Prosecutor. In these cases, tailored legal assistance is recommended.
📜 Legal Steps for a Civil Wedding in Rome
Foreigners wishing to legally marry in Rome must comply with Italian civil law, as outlined in Article 116 of the Italian Civil Code. Below are the primary legal requirements for non-Italian citizens:
1️⃣ Obtain a Nulla Osta or Certificate of Marriage Capacity
📌 A Nulla Osta (Certificate of No Impediment) must be issued by your home country’s embassy or consulate in Italy.
📌 If your country is a signatory of the Munich Convention, you will instead need a Certificate of Marriage Capacity, which is exempt from legalization and translation.
📌 Special procedures apply for American and Australian citizens, as outlined in our dedicated guides.
📌 A valid passport or identity document is required for all non-EU citizens.
2️⃣ Sworn Declaration for Non-Residents
📌 Foreign couples who are not residents in Italy must sign a sworn declaration stating that there are no legal impediments to their marriage.
📌 If one spouse is a resident in Italy, marriage banns (pubblicazioni di matrimonio) must be published in the municipality where they reside.
📌 Unlike many Italian cities, Rome allows your legal counselors to sign this declaration on your behalf via power of attorney, saving you time and unnecessary travel.

📜 How Does a Civil Wedding Work at the Town Hall of Rome?
If you are planning a civil wedding in Rome, understanding the legal procedures is essential. Our team will guide you through each step, ensuring a seamless experience at the town hall of your choice.
📝 Step 1: Submitting Your Required Documents
Before proceeding with your civil wedding, you must provide:
✔ Nulla Osta, duly legalized (and Atto Notorio if you are American or Australian).
✔ Certificate of Marriage Capacity, if your country adheres to the Munich Convention.
Important: If one of the spouses is a resident of Italy, the procedure requires the publication of marriage banns(pubblicazioni di matrimonio). In this case, the process will differ, and we will assist you in handling the necessary legal steps.
If both spouses are foreigners and not residents in Italy, you will follow the standard procedure.
📅 Step 2: Booking the Declaration of No Impediment
On your behalf, we will schedule an appointment at the Rome Town Hall to complete the Declaration of No Impediment.
📌 Purpose of this declaration:
This step confirms that no legal impediments exist due to:
- Kinship, affinity, adoption, or affiliation under Article 87 of the Italian Civil Code.
- Other legal barriers outlined in Articles 85, 86, and 88 of the Civil Code.
👥 Who needs to be present?
At this appointment:
✔ No witnesses are required.
✔ An interpreter is mandatory if either of you does not speak Italian fluently.
💍 Step 3: Your Civil Wedding Ceremony
After completing the Declaration of No Impediment, your wedding can be scheduled at the town hall venue of your choice.
📅 The wedding ceremony typically takes place the following day or within a few days, depending on the availability of the municipal office.
During the ceremony:
✔ The wedding is officiated by the Mayor of Rome or their authorized deputy.
✔ Two witnesses must be present.
✔ An interpreter is required if either spouse does not understand Italian fluently.
How is an Italian marriage recognized abroad?
When you get married in Italy, your marriage can be legally recognized in your home country or in another country. The procedure depends on the international agreement between Italy and that country.
✈️ Step 4: Recognition of your Civil Marriage in Your Home country or abroad
Vienna Convention (1976) – Simplest case
If both countries are part of the Vienna Convention, you can use a multilingual marriage certificate issued by the Comune.
No translation. No legalization. It is automatically accepted.
Hague Apostille Convention (1961) – Most common case
If the Vienna Convention does not apply, most countries follow the Hague Apostille Convention.
In this case, your Italian marriage certificate must be apostilled by the Prefettura to be valid abroad.
No Convention – Consular legalization required
If neither convention applies, you will need full consular legalization.
This means the document must go through multiple authorities and the consulate of the destination country before it can be accepted.
‼️Choosing your matrimonial property law (Art. 30, Law 218/1995)
There is also a key legal aspect many couples overlook.
Under Article 30 of Italian Law No. 218/1995, you can choose which law governs your matrimonial property regime (for example, your country of citizenship or residence).
This choice is officially recorded in the “estratto per riassunto dell’atto di matrimonio,” the only Italian certificate that shows your property regime and ensures it is recognized internationally.
