🇺🇸 Catholic and Civil Wedding in Italy for U.S. Citizens
This guide will help you understand the legal and religious procedures for both Catholic Church weddings and the so-called “matrimonio concordatario” (legal + catholic before the Priest) — which are recognized by both the Catholic Church and the Italian State and in the State where you live in the U.S.
Italy is the only countryin the world where you can celebrate a
Church + Legal wedding with full legal validity, thanks to the Lateran Pacts between the State and the Vatican.
This type of ceremony is known as matrimonio concordatario.

Option 1: Catholic Wedding Only (Canonical Ceremony)
(Canonical Ceremony – No Civil Effect)
If you wish to celebrate a religious-only wedding in a Catholic church in Italy — without a civil marriage — you must already be legally married in the United States before the ceremony takes place.
📄 Your U.S. civil marriage certificate must be submitted to your home parish, together with the required ecclesiastical documentation. This typically includes:
- recent baptism certificates for both spouses
- confirmation certificates (required in many, but not all, Italian dioceses)
- proof of completion of a prenuptial preparation course (often referred to as Pre-Cana)
- “Nihil Obstat” from your Bishop
📬 Your parish will forward the complete file to your diocese, which will then transmit it through official Church channels to the Italian diocese competent for the church where the ceremony will be celebrated.
⛪ The ceremony celebrated in Italy will be a Catholic canonical wedding, valid only under Church law.

Option 2: Catholic + Legal Marriage (Matrimonio Concordatario)
If you want your Catholic church wedding in Italy to have full legal effect, both in Italy and in the United States, this is the correct path.
Here’s how the process works:
⛪ Step 1: Catholic (Canonical) Preparation in the U.S.
Before leaving the United States, you must submit the required ecclesiastical documentation to your home parish. This typically includes:
- recent baptism certificates
- confirmation certificates (required by many, though not all, Italian dioceses)
- the Nihil Obstat issued by your Bishop
- proof of completion of a prenuptial preparation course (Pre-Cana)
Your parish forwards the complete file to your diocese, which then transmits it through official Church channels to the Italian diocese competent for the church where the wedding will take place.
The priest who will celebrate the marriage in Italy receives the finalized authorization.
👉 Step 2: Sworn Affidavit at the U.S. Consulate in Italy
Once you arrive in Italy (ideally at least one week before the wedding), each spouse must sign a sworn affidavit of no impediments before a U.S. Consular Officer.
We book the consular appointment and prepare everything in advance.
- The affidavit must be signed in person, in front of the Consular Officer
- You do not sign the document beforehand
- No documents from the United States are required
- You declare your marital status under oath and under your personal legal responsibility, according to the law of the U.S. state where you reside
📝 Step 3: Legalization at the Italian Prefettura
We then handle the legalization of the affidavit at the competent Prefettura, which certifies the U.S. Consul’s signature.
In most cases, and depending on timeline flexibility, this step can be completed on the same day as the consular appointment.
🏛️ Step 4: Atto Notorio before the Italian Court
When required by the Municipality, you will sign an Atto Notorio before the competent Italian Court.
This is a sworn statement confirming that you are free to marry according to the law of the U.S. state where you reside.
We accompany you to court and can provide the required witnesses if needed.
Only your passport is required.
As with the consular affidavit, no documents from the United States are requested, since this is a sworn declaration made under oath.
🏛️ Step 5: Town Hall Appointment (Comune)
You will attend, with us, an appointment at the Italian town hall that is territorially competent for the church where the matrimonio concordatario will be celebrated.
At this stage:
- you formally declare that there are no impediments under Italian law
- the civil registrar issues the delegation to the parish priest
For a concordat marriage, the priest acts both as a religious minister and as a public official.
💍 Step 6: Ceremony and Civil Registration
After the wedding ceremony:
- the priest transmits the marriage record to the town hall within five days
- the marriage is registered under Italian civil law
We then obtain your Italian civil marriage certificate and begin the recognition process for the United States.
🇺🇸 Recognition of Your Italian Marriage in the U.S.
If you’re wondering whether your marriage celebrated in Italy is valid in the U.S.
Once your concordat marriage has been duly registered under Italian civil law, we will take care of the following steps to ensure full usability of your marriage in the U.S.:
We will request from the town hall where the parish priest deposited the marriage record certified copies of your Italian civil marriage certificate in Italian.
‼️Multilingual certificates are not acceptable for U.S. recognition purposes, as they are issued under the Vienna Convention, to which the United States is not a signatory.
Specifically, we will obtain the “estratto per riassunto dell’atto di matrimonio.”
This is not just a standard marriage certificate. Under Italian law, it is the only official document that can report the spouses’ explicit choice of the law governing their matrimonial property regime.
In other words, when two foreign spouses marry in Italy, they have the possibility to formally choose which national law will regulate their financial relationship as a married couple (for example the law of the United States, Canada, the United Kingdom, Australia, etc.).
This possibility derives from Article 30 of Law No. 218/1995, which allows spouses to agree in writing that their property regime will be governed by:
• the law of the State of which at least one of them is a citizen, or
• the law of the State where at least one of them resides.
Once this choice is made at the time of the marriage, it is formally recorded in the marriage register of the Italian Municipality.
The key point is that this information appears only in the “estratto per riassunto dell’atto di matrimonio.”
Other certificates issued by the Italian Municipality, such as the multilingual certificate issued under the Vienna Convention, do not include this legal information.
👉🏻For this reason, as part of our service we always request from the Municipality the “estratto per riassunto dell’atto di matrimonio.”
This is the only certificate that clearly records the spouses’ choice of the law governing their matrimonial property regime.
Obtaining this document is particularly important for international couples, because it provides the official legal proof of which law regulates the spouses’ property relations, and it is often the most relevant certificate when the marriage must later be used or recognized abroad.
👉🏻We will then legalize the marriage certificate with an Apostille under the 1961 Hague Convention, issued by the competent Prefettura.
👉🏻Once the certificate is issued, we will appoint a professional translator.
The translation will be formally sworn before an Italian court official (asseverazione), certifying its accuracy and fidelity to the original Italian document.
👉🏻Because the sworn translation is an act of the Italian court, we will obtain a second Apostille from the competent Public Prosecutor’s Office, completing the legalization process.
At the end of this process, your Italian civil marriage certificate will be fully valid and usable in the United States for all legal purposes.
Please note that the Catholic marriage certificate issued by the parish priest immediately after the ceremony is a purely ecclesiastical document. It is valid within the Catholic Church worldwide and does not require apostille or translation, but it has no civil or legal effect outside the Church.

🇮🇹 Special Case: American Citizens Who are Also Italian (A.I.R.E. Registered)
If one of the spouses is both a U.S. citizen and an Italian citizen registered with A.I.R.E. (Anagrafe degli Italiani Residenti all’Estero), a specific legal process must be followed. It includes additional steps required by Italian law for citizens living abroad.
📝 Step-by-Step Process
👉 1. Travel to Italy
You must come to Italy to:
- Obtain the atto notorio at the court
- Legalize the affidavits issued at the U.S. consulate (as described above)
✈️ Once you’re back in the U.S.:
📣 2. Attend the Marriage Banns (Pubblicazioni di matrimonio)
- Go to the Italian Consulate to initiate the banns
- Submit the legalized affidavits and the atto notorio
- The banns will be posted for 11 days
📩 3. Consular Authorization
Once the banns are completed, the Consulate will send an official communication to the Italian town hall you selected, authorizing your civil marriage.
💒 4. Return to Italy for the Ceremony
- You will return to Italy for the concordat wedding ceremony
- Your civil and Catholic marriage will be celebrated together before a Catholic priest of your choice
