Obtain Your Nulla Osta and Meet All Legal Requirements for a Civil Wedding in Italy for Slovenian Citizens
Are you a Slovenian citizen dreaming of a romantic Italian wedding?
If so, it’s essential to meet specific legal requirements to ensure your marriage is legally recognized in Italy.
One key requirement is obtaining a “Nulla Osta,” a document issued by your Consulate in Italy confirming that there are no legal obstacles to your marriage, in accordance with both Slovenian and Italian laws.
Our expert guide walks you through the process of obtaining a “Nulla Osta” and understanding the legal steps for foreign marriages in Italy.
Understanding the Italian “Nulla Osta”
In the context of marriage laws in Italy, the “Nulla Osta” stands out as a vital document for Slovenian citizens planning a wedding in Italy.
This certificate is issued by the Embassy of the Republic of Slovenia, confirming there are no legal barriers to your proposed marriage.
As the first step in the Italian marriage requirements checklist, the “Nulla Osta” is a must-have document for Slovenian citizens planning an Italian wedding.
The “Nulla Osta” – A Key to Italian Wedding Legalities
Obtaining the “Nulla Osta” is simple with the correct guidance. To secure this certificate, Slovenian couples need to send specific documents to us, your legal counselors in Italy, as follows:
- An original international birth register extract for both parties, if they are Slovenian citizens.
- A “no impediment to marriage” certificate for both parties from the Slovenian Administrative Unit, if they are Slovenian citizens.
- Identification documents (ID card or passport). In cases where one party is a foreign citizen, their ID, indicating citizenship and personal data, is also required.
- A consular fee of 38.00 Euros.
As your legal counselor in Italy, to act on your behalf will ask you to sign a power of attorney so that we are allowed to request the Nulla Osta on your behalf.
Once the “Nulla Osta” is issued, all original documents are returned. This crucial step brings you closer to achieving your dream Italian wedding.
How Does a Civil Wedding Work at the Town Hall?
Once we have gathered your nulla osta, duly legalized by us in the competent Prefettura, you will be ready for the first meeting at the town hall selected by the couple.
Please note that if one of the two parties is a resident of any municipality in Italy, the procedure differs, and marriage banns must be published (please read our post about pubblicazioni di matrimonio).
If you are a foreigner who is not a resident in Italy, you will follow the standard procedure.
We will book, on your behalf, the declaration confirming the absence of impediments due to kinship, affinity, adoption, or affiliation under Article 87, numbers 1, 2, and 4 of the Civil Code, as well as any other impediments under Articles 85, 86, and 88 of the same code.
At this appointment, no witnesses are required, but an interpreter is mandatory if either of you needs assistance understanding Italian properly.
Generally, the day after—or a few days later, depending on the town hall’s availability—you can get married in the selected room, in the presence of the Mayor of the town or their deputy, two witnesses, and an interpreter (if needed).
Navigating Italian Marriage Laws Post “Nulla Osta”
If the town hall release you the multilingual marriage certificate provided by the Vienna Convention of September 8, 1976 (submitted since Dec. 31, 1992), neither Apostille nor translation is need and the Italian marriage certificate is automatically recognized in Slovenia.
Otherwise if the town hall will release you a standard marriage format your wedding planner will proceed with the legal translation at the Italian Court (asseverazione) and the legalization with the Apostille in the competent prefettura.
Having secured the “Nulla Osta”, it’s time to dive deeper into the Italian marriage laws. Consulting a local legal expert or an agency experienced in Italian wedding legalities can ensure you follow the required procedures correctly.
This guide aims to assist Slovenian couples in understanding Italy’s primary legal marriage requirements. Remember, regulations may vary, and seeking professional legal advice can provide an easier path to your unforgettable Italian wedding.
